New resolution N°123/2019 in relation to trademarks in Argentina
Dear Friends and Colleagues,
 
 
We are pleased to inform you that on May 27th the Trademark Office issued a new resolution, casting some light on the wording of the new Trademark Law (January 2018) and it´s even newer Regulatory Decree (April 2019).
 
 
This new resolution, N°123/2019, among other situations, stipulates the following:
 
 
1- That multiclass applications are not allowed. Even though the requirement of filing a single application per class had been removed from the Trademark Law, this new resolution stipulates that an application for each class must be filed.
 
 
2-Determines that the Sworn Statements of Use will only apply to trademarks and renewals granted as of January 12, 2013.
 
 
3- Determines a grace period to fulfill the Sworn Statement of use for trademarks granted between January 12, 2013 and January 12, 2014.
 
 
4- That trademark renewals can be filed as from six months prior to its deadline, until six months past said deadline (*).

(*)If the renewal is filed after its original deadline, it will only be accepted if does not harm third party´ rights acting in good will.
