After more than a decade of restrictive examination criteria, the joint ministerial resolutions affecting chemical‑pharmaceutical patent applications in Argentina have finally been repealed.

From now on, both new applications and those currently under prosecution will be examined strictly under Argentina’s Patent Law, with no additional restrictions based on the field of technology.

This is a major milestone for the Argentine patent system and a very welcome piece of news for applicants, bringing us significantly closer to international standards and providing much‑needed legal certainty.

We will be sharing shortly a detailed analysis of the practical implications and best courses of action to take advantage of this long‑awaited change.
